1. Introduction

Welcome to The Website Shop! By engaging with our services, you agree to the terms and conditions outlined below. These terms ensure a clear understanding between us and help deliver the best possible experience for your website needs.

 

2. Services Provided

2.1 We offer a full-service website design, development, hosting, and maintenance package. This includes ongoing updates and support for your site at a fixed monthly cost. Additional services or features may be discussed and agreed upon separately.

 

3. Pricing and Payment

3.1 Our standard website build is $699+gst, with an ongoing monthly fee of $69+gst for hosting, maintenance, and updates.

3.2 Our shopping website build is $1399+gst, with an ongoing monthly fee of $139+gst for hosting, maintenance, and updates.

3.3 We offer a risk-free guarantee with no deposits and no minimum terms. If you are not satisfied with the final result, you do not have to pay, however all content produced by The Website Shop remains the property of The Website Shop until paid for.

3.4 Once the site is live we send the invoice for the build which is due within 14 days.

3.5 Our monthly invoices are sent on the first of each month for other services provided in the previous month. The invoice is due on the 20th of the current month.

 

4. Client Responsibilities

4.1 Legal Operation: By using our services, you confirm that you have the legal right to operate your business and comply with all applicable laws and regulations.

4.2 Content Accuracy: You are responsible for reviewing and ensuring the accuracy of all content on your website.

4.3 Legal Rights for Provided Content: Any content, images, fonts, or other materials you provide must be legally yours to use. You must have the appropriate rights or permissions for their use. If you are unsure please discuss this with us.

 

5. Indemnification

5.1 Content and Legal Compliance: You agree to indemnify and hold The Website Shop harmless from any legal claims or disputes arising from the content you provide or the operation of your business.

5. 2 Downtime and Service Interruptions: While we strive to keep your website running smoothly, downtime can occur. We are not responsible for any costs or losses incurred due to website downtime.

 

6. Ownership and Transfer

6.1 Once you have paid the initial build invoice you retain full ownership of your website and domain. If you decide to cancel our services, we will provide you with all necessary files to transfer your website to another host.

6.2 At all times you retain ownership of any domain name registered or managed on your behalf by The Website Shop.

6.3 Our websites are built on WordPress, a widely-used platform, ensuring compatibility with most hosting services.

 

7. Termination

7.1 Either party may terminate the service at any time for any reason.

7.2 If you terminate the service, you do not need to provide any notice.

7.3 If The Website Shop terminates the service we will provide you with 14 days notice.

7. 4 If requested at any point we package up all website and database files and send them to you. These files will be available for a minimum of 30 days after termination of service.

7.5 Upon termination, you will be responsible for any ongoing cost for any services you choose to use to keep your site running in the future (including any website hosting, domain registration or ongoing plugin costs).

 

8. Promotion and SEO

8.1 Upon launch, we will register your website with Google and optimise it for search engines.
While we ensure your site is search-ready, achieving high search rankings takes time and may require additional promotion or advertising, depending on your business’s competitiveness. We will happily discuss this with you at any time.

 

9. Email Services

9.1 We can set up email accounts associated with your domain. While there is no cost for this service, you may opt for paid email hosting through Google Workspace or Office 365, billed directly by Google or Microsoft.

 

10. Contact and Communication

10.1 We aim to be as accessible as possible. Feel free to reach out via phone, email, or video call with any questions or requests. However, as we may not be available at all times on the phone, email is the best form of contact.

10.2 We endeavour to ensure all errors or outages are fixed within 24 hours and strive to complete all updates within 7 days.

 

11. Amendments to Terms

11.1 These terms may be updated from time to time. Continued use of our services will constitute your acceptance of the updated terms.
